Right of Access
WHAT IS IT?
This is the right to access public information, in the terms provided for in article 105.b) of the Spanish Constitution. Public information is understood as the contents or documents, whatever their format or type, which are held by persons subject to Law 8/2015, March 25, Transparency of Public Activity and Civic Participation in Aragon prepared or acquired in the exercise of their functions.
Anyone has the right to access public information without having to give reasons for their request.
Access to the information will be free in general, and will be made available in the requested form or format, whenever possible.
Requests for the right of access to public information follows the procedure established in Law 19/2013, December 19, Transparency, access to public information and good governance, and Law 8/2015, March 25, Transparency of Public Activity and Civic Participation in Aragon.
The Order, October 26, 2015, from the Citizenship and Social Rights Councillor, which establishes instructions on the processing, monitoring, control and registration of requests for access to public information is also applicable.
The right of access in Aragon Law includes the following specific requirements:
- The applicant will receive prior notification within a maximum period of 10 days from the receipt of the request by the competent body to resolve it, indicating the request receipt date, the deadline for its resolution and effects of a lack of administrative response.
- As a general rule, once the maximum term for resolution has elapsed without the applicant having received a response, it will be understood that the request has been sustained.
- The resolution of prior discretionary claims regarding the right of access to public information corresponds to the Aragon Transparency Council.
The entities and bodies competent in matters of the right of access to public information are those included in the Annex to Decree 215/2014, December 16, Aragon Government, attribution of competencies when citizens exercise the right of access to public information within the scope of the Autonomous Community of Aragon Administration and its public sector.
